1. Introduction

Welcome to Vana NextGen Technologies. These Terms and Conditions ("T&Cs") govern your access to and use of our services through our website, mobile application, or any other medium ("Platform"). By using our services, you agree to be bound by these T&Cs, our Privacy Policy, and any other legal agreements that we may provide.

If you do not agree with these T&Cs, you must discontinue using our services immediately.

2. Definitions

  • Tanker Tap: Mobile application developed and managed by Vana NextGen Technologies for booking water tankers.
  • Service: The water delivery service provided through the Platform (Tanker Tap).
  • User: Any person or entity using the Platform to book water tanker delivery services.
  • Service Provider: Independent third-party water tanker operators fulfilling the water delivery orders.
  • Platform: The website, mobile application, or any other digital interface provided by Vana NextGen Technologies for accessing the Service.

3. Eligibility

By using the Platform, you confirm that:

  • You are at least 18 years old.
  • You have the legal capacity to enter a binding contract.
  • You comply with these T&Cs and all applicable laws and regulations.

4. User Accounts

To access certain features, you may need to register for a User Account. You agree to:

  • Provide accurate and current information during registration.
  • Maintain the security of your password and account.
  • Be responsible for all activities under your account.
  • Notify us immediately of any unauthorized account use.

5. Service Provision

Vana NextGen Technologies acts solely as a facilitator, connecting Users with independent Service Providers. We are not responsible for the actions or conduct of any Service Provider.

6. Quality of Water

We ensure high water quality standards:

  • Water Source Compliance: Water must originate from sources meeting local regulations.
  • Regular Testing: Service Providers must conduct regular quality checks.
  • Customer Assurance: If water quality is in doubt, contact customer support for investigation, replacement, or refund.

7. Pricing

  • Transparent Pricing: Prices are listed at the time of booking. No hidden fees.
  • Price Changes: Prices may change without prior notice, but your confirmed booking price remains unchanged.
  • Additional Charges: Extra services (e.g., extra hose length) will be communicated upfront.

8. Cancellation Policy

8.1 User-Initiated Cancellations

  • Before Dispatch: Full refund; a cancellation fee may apply.
  • After Dispatch: Partial refund, covering costs incurred.

8.2 Service Provider-Initiated Cancellations

  • Alternative Arrangements: We will attempt to find another provider.
  • Refund: If no alternative is available, a full refund will be issued.

8.3 Force Majeure

Neither party is liable for cancellations due to unforeseen events (e.g., natural disasters). Rescheduling will be attempted.

9. Delivery Issues

9.1 Wrong Address

  • No refund for incorrect address.
  • Rebooking with the correct address will be treated as a new booking with applicable charges.

9.2 No Access to the Road

  • Attempted Delivery Fee: Charges may apply.
  • Rescheduling: Allowed once access issues are resolved; additional fees may apply.

10. Rewards Program

  • Earning Rewards: Through bookings, referrals, and promotions.
  • Using Rewards: Can be redeemed for discounts or offers.
  • Expiration: Rewards may expire; details will be provided on the Platform.
  • Program Changes: We reserve the right to modify or terminate the program at any time.

11. User Responsibilities

Users must:

  • Provide accurate booking details.
  • Cooperate with Service Providers.
  • Comply with all relevant laws.

12. Prohibited Activities

Users must not:

  • Use the Platform for illegal purposes.
  • Disrupt Platform operations.
  • Misrepresent identity or provide false information.
  • Transmit harmful code, viruses, or malware.

13. Intellectual Property

All content and trademarks on the Platform belong to Vana NextGen Technologies. Users must not:

  • Copy, modify, or distribute Platform content without consent.
  • Use company trademarks without authorization.

14. Limitation of Liability

  • No Warranty: The Platform and Service are provided "as is."
  • No Liability: We are not responsible for indirect or consequential damages.
  • Indemnification: Users agree to indemnify us from any claims or damages arising from Platform use.

15. Dispute Resolution

  • Negotiation: Parties will first attempt informal resolution.
  • Arbitration: If unresolved, disputes will be arbitrated in Koppa, Chikmagalur, Karnataka.
  • Governing Law: These T&Cs are governed by the laws of India.

16. Modifications

We reserve the right to modify these T&Cs at any time. Continued use of the Platform after changes constitutes acceptance.

17. Termination

We may suspend or terminate access to the Platform for any violation of these T&Cs. Upon termination, rights to use the Platform cease immediately.
